The rules for using the ActivGoals app and website.
These Terms of Service govern your use of the ActivGoals mobile app (iPhone and Android) and the related website (the “Service”), published by ActivForge (“we”). By creating an account or using the Service, you accept these terms. If you do not accept them, do not use the Service.
ActivGoals offers training plans (walking, running, treadmill, steps, strength exercises such as push-ups or planks), session tracking, progress tracking, challenges, and optional groups to train with others. The Service is currently provided free of charge and may display advertising.
We may add, change or remove features at any time, and we may suspend or stop the Service, with reasonable notice where possible.
You sign in with a link sent to your email address. You are responsible for keeping access to that email address secure and for activity on your account.
You can delete your account at any time from the app (Account) or by following the instructions at /delete-account.
If you are under the age of majority in your province, state or country (18 in Quebec), you may only use the Service with the permission of a parent or guardian, or within a supervised group (for example a sports team with a coach). Parents and coaches are responsible for supervising the use of the Service by the minors in their care.
ActivGoals is not a medical service and does not provide medical advice. Consult a doctor before starting or changing an exercise program, especially if you have a health condition, an injury or are pregnant.
Exercise at your own pace and stop immediately if you feel pain, dizziness or discomfort. When walking or running outdoors, stay aware of your surroundings and follow traffic rules. When using a treadmill, follow the manufacturer’s safety instructions.
You train at your own risk.
Rep counting with the camera (push-ups, squats, plank, etc.), step counts, distance, pace and other measurements are estimates and may be inaccurate. They are provided for motivation and information only.
The camera images used for counting are processed on your device. They are not sent to our servers, except if you explicitly choose to share a session for analysis when this option is offered to you.
In a group, other members, coaches and the group owner can see your display name and your activity results for the group’s plans. Do not share content you do not want others to see.
You are responsible for the content you post (display name, messages to support, etc.). Content must not be illegal, offensive, harassing, or infringe the rights of others. We may remove content or suspend accounts that break these rules.
You agree not to: use the Service for any unlawful purpose; attempt to access other users’ accounts or our systems without authorization; interfere with the operation of the Service; reverse-engineer the app except where the law allows it; manipulate challenges, rankings or podiums by fraudulent means; or harass other users.
The Service may display ads provided by Google AdMob. How advertising data is handled is described in our Privacy Policy.
Our Privacy Policy explains what data we collect and how we use it. It forms part of these terms.
The app, its content (plans, texts, images, logos) and the ActivGoals name belong to ActivForge or its licensors. We grant you a personal, non-exclusive, non-transferable licence to use the app for your own use, in accordance with these terms and with the rules of the App Store or Google Play.
The Service is provided “as is” and “as available”, without warranty that it will be uninterrupted or error-free. To the extent permitted by law, we are not liable for indirect damages, loss of data, or injuries resulting from physical activity performed while using the Service.
Nothing in these terms limits rights that you have under the consumer protection laws that apply to you, including the Quebec Consumer Protection Act, or liability that cannot be excluded by law.
You may stop using the Service and delete your account at any time. We may suspend or close an account that seriously or repeatedly breaks these terms.
We may update these terms. The date of the latest version is shown below. If the changes are significant, we will inform you in the app or by email before they take effect. Continuing to use the Service after that means you accept the new terms.
These terms are governed by the laws of the Province of Quebec and the federal laws of Canada that apply there. Subject to the mandatory rules that protect consumers where they live, disputes fall under the jurisdiction of the courts of Quebec.
